Acceptance of Dallah Al-Arab’s veto of a ruling in favor of the Danube
Today, Sunday, the Bin Dawood Holding Company announced that the court has accepted the cassation of the ruling issued in favor of the Danube Foodstuff and Luxuries Company, a subsidiary of the “Bin Dawood” company, against Dallah Al Arab.
And “Bin Dawood Holding” stated, in a statement on “Saudi Tadawul”, that Dallah Al-Arab Company requested a cassation to the Supreme Court of the judicial ruling issued by the Third Appeal Chamber of the Commercial Court in Jeddah on Jumada II 1443 AH corresponding to January 29, 2022 AD in favor of the Danube Company for Foodstuffs and Luxuries and the judge. Not accepting the lawsuit filed by Dallah Al-Arab Company and announced on Jumada II 22, 1443 AH, corresponding to January 25, 2022 AD.
She added that she had received the judicial notification on Rabi’ al-Thani 13, 1444 AH, corresponding to November 7, 2022 AD, which includes setting a date for a session on Rabi’ al-Thani 28, 1444 AH, corresponding to November 22, 2022 AD, to consider the case before the Second Appeal Chamber of the Commercial Court in Jeddah, and accordingly the aforementioned session was attended, and the department indicated that a decision had been issued. Supreme Court No. (6228513) dated 09 Rabi’ al-Thani 1444 AH corresponding to November 3, 2022 AD, and the judge, as follows, “overturning the judgment issued by the Third Appeal Chamber of the Commercial Court in Jeddah on Jumada II 26 1443 AH and returning the case to the court.”
And “Bin Dawood” continued: “Successively, three sessions were attended before the Second Circuit in the Commercial Court in Jeddah on Jumada Al-Awwal 25, 1444 AH, corresponding to December 19, 2022 AD, and the date of Jumada Al-Akhirah 11, 1444 AH, corresponding to January 4, 2023 AD, and finally the session held on Jumada Al-Awwal 23, 1444 AH, corresponding to January 16, 2023 AD. The case is still under consideration by the department, and a next session has been set on Rajab 22, 1444 AH, corresponding to February 13, 2023 AD, to complete the case’s deliberations.”
Bin Dawood confirmed the strength of its legal position in the case, based on the confirmation of the company’s external lawyer.
Dallah Al-Arab Company had filed a lawsuit, in which it demanded compensation in the amount of 124.125 million riyals, in addition to an amount of 300 thousand riyals for attorney’s fees, according to a previous statement, for what it called damages resulting from a patent infringement.
